Main Street Payday Advance is committed to following our Best Practices:
- Full disclosure. We will comply with the disclosure requirements of the State of New Hampshire and with Federal disclosure requirements including the Federal Truth in Lending Act. A contract between Main Street Payday Advance and the client must fully outline the terms of the payday advance transaction. We agree to disclose the cost of the pay day advance as a dollar amount and as an annual percentage rate (“APR”).
- Compliance. We will comply with all applicable laws. We will never charge a rate or add a fee for a payday advance that is not authorized by State or Federal law.
- Truthful advertising. We will not advertise our payday advance service in any false, misleading, or deceptive manner.
- Encourage consumer responsibility. We shall inform consumers of the intended use of payday advance services and the availability of credit counseling services.
- Rollovers. We will comply with State laws on rollovers (the extension of an outstanding advance by payment of only interest). In New Hampshire rollovers are specifically not allowed. We will not, under any circumstances, allow a customer to do a rollover in NH.
- Right to rescind. We will give our clients the right to rescind, at no cost, a payday advance transaction on or before before 5 p.m. Eastern Time the following business day.
- Appropriate collection practices. We are committed to collecting past due accounts in a professional, fair and lawful manner. Our representatives will not use unlawful threats, intimidation, or harassment to collect accounts. We comply with collection limitations contained in the Fair Debt Collection Practices Act (FDCPA) and use it as a guide to our practices in this area.
- No criminal action. We will not threaten or pursue criminal action against a client as a result of the client's check being returned unpaid or the client's account not being paid.
- Enforcement. We monitor employee compliance with our Best Practices.
- Military. We will comply with all State and Federal laws that apply to the identification of members of the military and their dependents. We do not extend loans to active members of the military or their dependents.
